Rules & Regulations for Renters

CHECK-IN: Check in is 3 PM EST. No early arrivals will be permitted. You will receive an email with specific check-in instructions approximately 2-3 days prior to arrival.

CHECK-OUT: Check out is by 10 AM EST. Please comply with the posted check out time to avoid additional charges.

PAYMENT POLICY: A $300 pre-payment or specified prepayment is due to confirm the reservation.

Short Term Reservations of less than 30 nights—The full rental payment is required 14 days prior to arrival.

Seasonal Reservations 30+ Nights—The full rental payment is required 60 days prior to arrival. For each additional month, the payment is due each following month until reservation is paid in full.

Accepted payments-Visa, Master Card, AMEX, Discover. Personal checks (E-Checks) are available through the guest portal.

RESERVATION & CONFIRMATION DEPOSITS: Web booking requests are subject to verification by St. Augustine Ocean & Racquet Resort rental personnel. All reservations are tentative until the $300 deposit or specified prepayment is received. Reservations will be subject to the cancellation policy as stated herein.

CANCELLATION/CHANGE POLICY: For reservations less than a 30-night stay (short-term)-Cancellations will be accepted up to 14 days prior to the scheduled arrival date with a full refund. Cancellations made less than 14 days will result in 100% forfeiture of Reservation Fee and Booking Fee. seasonal reservations must be cancelled 60 days prior to the scheduled arrival date to receive a full refund. Cancellations made between 59 and 30 days prior to arrival will result in 50% forfeiture of Rental Fee and Booking Fee. Cancellations made less than 30 days prior to the scheduled arrival date will result in 100% forfeiture of Rental Fee & Booking Fee. Payment for reservations may be made in the guest portal and Visa, MasterCard, Discover, or American Express and E- check are acceptable forms of payment and are subject to applicable fees. No refunds for early departure.

DAMAGE OR MISUSE: All rental units are inspected before and after occupancy. Rental guests have full financial responsibility for damages due to misuse, missing items, negligence, or failure to comply with all items on the Check-Out Procedures (included with your check-in instructions).

DAMAGE INSURANCE: As a part of your stay, you may purchase a Vacation Rental Damage Protection plan designed to cover unintentional damages to the rental unit interior that occur during your stay provided they are disclosed to management prior to check-out. If purchased, the policy will pay a maximum benefit of $3,000.00. Any damages that exceed $3,000.00 or are not covered under the plan will be charged to the credit card on file. If, during your stay at one of our rental properties, an insured person causes any damage to real or personal property of the unit because of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $3,000.00. Certain terms and conditions apply. Full details of the Vacation Rental Damage coverage are contained in the Description of Coverage or Insurance Policy. You may request this information. The Vacation Rental Damage Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request Customized Services Administrators, Inc. d/b/a Generali Global Assistance & Insurance Services to pay directly St. Augustine Ocean & Racquet Resort any amount payable under the terms and conditions of the Vacation Rental Damage. Please contact St. Augustine Ocean & Racquet Resort directly if you do not wish to participate in this assignment as a security deposit of $500 minimum will be required. This does not apply to AirBNB guests as they are covered by AirBNB directly.

RULES & REGULATIONS: All rental condo rules and regulations must be followed. Failure to abide by the rules and regulations will cause your tenancy to be terminated immediately with no refund.

REFUNDS: All units are privately owned. Rates, descriptions, bed sizes, inventories and furnishings are subject to change without notice. We make every effort to keep each unit and its equipment in good working order. In the event of a breakdown, we will strive to make repairs as soon as possible. Neither the rental agent nor the owner will be obligated to provide replacements or give refunds for the failure or absence of any item or for any public utility failure (including TV or WIFI failures). No refunds are given for early departures due to inclement weather. In the event of a Hurricane Warning for which a mandatory evacuation order for our area has been issued, a special consideration will be given.

MAXIMUM OCCUPANCY: The maximum occupancy is the number of people the rental sleeps including infants. Occupancy limits are in accordance with the rules of the State Fire Marshall’s Office. No exceptions will be made. Maximum occupancy for two-bedroom units is six (6).

PETS: No pets are allowed. Pets reported on the property are to subject to immediate removal from the property at the renter’s expense. A minimum charge of $100.00 will be assessed for treatment of the condominium for pets and pet damaged. Forfeiture of deposit will also be imposed.

SMOKING: **NO SMOKING (CIGARETTE OR OTHERWISE) OR VAPING IS ALLOWED IN RENTAL UNIT AT ANY TIME DURING THE

LEASE PERIOD. Should a smoke smell be found in the unit after the guest vacates, a fee of no less than $500 will be charged to the credit card on file for clean-up efforts and damages. 

CARE OF PREMISES: The tenant agrees to use the property in a reasonable manner and to refrain from damaging property in

any way. Any damage done to the premises by the tenant, tenant’s family or guests shall be paid for by the tenant. Any disorderly conduct, including drunkenness, loud disturbing noises, disturbing neighbors in any manner, or misuse of property will warrant prompt and immediate vacating without prior notice and without refund of monies paid. Any accidental damage occurred during stay will be reported immediately to the rental office and will be discussed with owner for prompt payment by tenant for damages. The tenant agrees to keep the property, inside and out, in clean and orderly during their rental term. See Damage Insurance*

CAMPERS, BOATS, WATERCRAFT, TRAILERS, VEHICLES WITH ADVERTISEMENTS AND MOTOR HOMES ARE NOT ALLOWED ON THE PREMESIS.

CLEANING: If you feel the unit is not cleaned adequately, please let us know within 12 hours of arrival so we can attempt to fix the issues. No portion of the cleaning fee will be refunded if we are not informed within 12 hours of any issues. Tenant has paid for a departure cleaning which will occur after the tenant vacates property.

STARTER KIT OF SUPPLIES: Included with your rental is 2 trash bag per can, 1 roll of toilet paper per bathroom, 1 roll of paper towels, 1 dishwasher POD, 3 laundry detergent PODS. Some luxury condos will also provide travel toiletries.

SOFA BEDS: Some units may have sofa beds. Please note that sofa beds and hide away beds are inherently uncomfortable. NO refunds will be given due to discomfort of these beds.

INSPECTION BY OWNER OR AGENT: The owner, their representative or agent may inspect the premises at any time for any purpose during the lease period.

RENTAL UNITS FOR SALE: Rental units may be for sale. In that event, owners reserve the right to allow showings by themselves or by agents to qualified buyers by appointment only. Guests will be notified in advance.

RIGHT TO CHANGE RENTAL ASSIGNMENTS: We reserve the right to change rental assignments without prior notice or liability in the event of a sale of the rental unit or if the unit becomes unavailable for any reason. If the guests leave the unit and change to another unit, they are responsible for the rent for the time occupied, cleaning, taxes, plus all charges for the new rental.

INJURY TO PERSON OR PROPERTY OF TENANT: The tenant will be responsible for any injury or damage to the person or property of the tenant, tenant’s family, guests or visitors during the lease period, and the owner or its agent are not responsible or liable in any manner for injury, sickness to include COVID-19, or damage to the parties mentioned above during their occupancy of the leased premises, the tenant agrees to indemnify and hold harmless the owner, or his agent for any claims or damages that might be asserted against the owner or his agent resulting from occupancy of the premises by tenant, tenants family, guests or visitors.

This agreement shall be governed by the laws of the state of Florida. Each of the parties irrevocably consents to the exclusive personal jurisdiction of the federal and state courts located in Florida, as applicable, for any matter arising out of or relating to this Agreement.

SIGNATURE/CHECKING “I AGREE” INDICATES AGREEMENT TO FORMS AND CONDITIONS SET FORTH ABOVE.  THE PERSON SIGNING THIS AGREEMENT IS AT LEAST 23 YEARS OF AGE AND WILL BE OCCUPYING THE UNIT DURING THE TERMS OF THE LEASE
